These Terms of Service govern your use of Pistache Postiz (“Pistache Postiz”, “the Service”), the social media scheduling platform operated by Agence Pistache (7 rue Gaston de Flotte, 13012 Marseille, France). By accessing or using Pistache Postiz, you agree to be bound by these Terms.
1. Who we are
Pistache Postiz is operated by Agence Pistache, a French social media agency. The Pistache Postiz application is hosted at https://meta.postiz.agence-pistache.fr. Our marketing website is https://agence-pistache.fr. Our Privacy Policy is available at https://agence-pistache.fr/pistache-postiz-privacy-policy.
2. The Service
Pistache Postiz is a social media publishing and scheduling tool. It allows authenticated users to connect their accounts on third-party networks (TikTok, Instagram, Facebook, LinkedIn, YouTube, X, Pinterest, Threads, Bluesky, Mastodon, Reddit, and others), plan content, schedule posts, publish to the connected networks, and view aggregated analytics for the posts they publish through Pistache Postiz.
3. Eligibility and account
You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use Pistache Postiz. You are responsible for keeping your Pistache Postiz credentials confidential and for all activity that occurs under your account.
4. Acceptable use
You agree not to use Pistache Postiz to:
- Publish content that is unlawful, defamatory, harassing, hateful, obscene, or that infringes any third-party rights.
- Spam, mass-publish identical content, or otherwise abuse the connected social networks.
- Violate the terms of service, community guidelines, or developer policies of any connected platform (including TikTok’s Terms of Service, Community Guidelines, and Developer Terms).
- Attempt to reverse-engineer, disrupt, or gain unauthorized access to Pistache Postiz infrastructure.
5. Third-party platforms
Pistache Postiz publishes content to third-party social networks on your behalf. Once content is delivered to a third-party platform, its terms govern that content. In particular, your use of TikTok through Pistache Postiz is also subject to TikTok’s Terms of Service, Community Guidelines, and Privacy Policy. Pistache Postiz is not affiliated with, endorsed by, or sponsored by any of the third-party platforms.
6. Content ownership
You retain ownership of all content you publish through Pistache Postiz. You grant Pistache Postiz a limited, non-exclusive, royalty-free license to host, transmit, and deliver that content to the third-party platforms you have connected, solely for the purpose of providing the Service.
7. Intellectual property
The Pistache Postiz software, brand, logo, and design are the property of Agence Pistache or its licensors and are protected by intellectual property law. You may not reproduce, modify, or redistribute the Pistache Postiz interface or codebase without prior written consent.
8. Disclaimer
Pistache Postiz is provided “as is” and “as available”, without warranty of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or fully compatible with every third-party API change at all times.
9. Limitation of liability
To the maximum extent permitted by law, Agence Pistache shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of Pistache Postiz, including but not limited to lost profits, lost data, or business interruption.
10. Termination
You may stop using Pistache Postiz at any time. We may suspend or terminate your access to Pistache Postiz if you breach these Terms or use the Service in a way that endangers other users or the connected platforms.
11. Governing law
These Terms are governed by French law. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Marseille, France.
12. Changes
We may update these Terms from time to time. The latest version is always available at https://agence-pistache.fr/pistache-postiz-terms-of-service. Continued use of Pistache Postiz after an update constitutes acceptance of the revised Terms.
